1. Jacks Point Residents and Owners Association Incorporated
Each purchaser at Jacks Point becomes a member of the Jacks Point Residents and Owners Society Incorporated, a society [to be] formed under the Incorporated Societies Act 1908. The Society's operations are governed by the rules in its constitution. These rules are a public document, and prospective purchasers are encouraged to obtain a copy of the Society's constitution.
2. What Does The Society Do?
The Society's main responsibilities include:
  • providing to residents those utility services which are not made available by the Queenstown Lakes District Council at Jacks Point, such as water and waste water disposal
  • owning and maintaining the "open space" which surrounds the Jacks Point development and the golf course
  • maintaining and up keeping the Jacks Point roads
  • regulating the design scheme for Jacks Point, aimed at ensuring a harmonious and integrated development
  • making bylaws appropriate for the benefit of residents at Jacks Point (for example, for use of the open space)
  • calculating and collecting the levies it requires to perform its functions.
3. Who runs the Society
The Society's functions are performed by a committee elected by the residents at Jacks Point. The committee can appoint a manager and others to help it with the day to day running of the development.

On matters on which all members are entitled to vote, each property is entitled to one vote (where there is more than one property owner, the property owners decide amongst themselves who will exercise that vote). As is normal for a development such as Jacks Point, during the ongoing development phase, the developer can retain some control over the activities of the Society and its committee to help the overall integrity of the development.

[While the developer is involved with the Society, the developer intends to assist the Society with its overall governance and asset management, including through the preparation of processes and procedures to help the Society's ongoing performance of its functions and responsibilities.]

The Society will hold annual general meetings, and members will receive notification of meetings as set out in the rules. The Society's financial statements will be audited.

4. Levies
The Society will set and collect the levies it requires to perform its functions. Levies will be set and payable per property. At the request of a member, the Society will provide an estimate of the levies for that member's property for the financial years to 30 June 2010. Further information about the estimated levies is available from the developer on request. The levies collected by the society from its members can only be used for the purposes of the Society.

Note that property rates will be charged and payable by property owners to Queenstown Lakes District Council/Otago Regional Council.
5. What Say I Am No Longer A Property Owner at Jacks Point?
On sale of your property at Jacks Point, you are no longer entitled to membership of the Society. The new purchasers of the property will be required to become members of the Society. You will need to pay any outstanding levies on your property and notify the Society of the sale.
